CODE OF CONDUCT: PROTECTION OF CHILDREN AND ADOLESCENTS (ESNAT) – ANDINA TRAVEL

ANDINA TRAVEL strictly adheres to the Code of Conduct for the Protection of Children and Adolescents against Sexual Exploitation and other forms of Violence in Tourism (ESNAT), in full compliance with the guidelines issued by the Peruvian Ministry of Foreign Trade and Tourism (MINCETUR). This document ratifies our absolute commitment to safeguarding the rights of minors and our active participation in the eradication of Commercial Sexual Exploitation of Children and Adolescents (CSEC) and any form of abuse. This policy constitutes a fundamental pillar of our ethical and responsible operation in Cusco.

1. Legal Compliance and Reference Framework

Our protection policy is based on the Peruvian legal framework and international treaties ratified by the State, guaranteeing the maximum protection of the rights of children and adolescents.

  • Regulatory Basis: Our actions are based on Law No. 29408 (General Tourism Law), the Code of Children and Adolescents, and the Regulations of the ESNAT Code of Conduct. Compliance is binding for all our human capital and strategic partners.
  • Zero Tolerance: We implement a zero-tolerance policy against any signs of exploitation, mistreatment, or abuse. Upon any suspicion, ANDINA TRAVEL will proceed with an immediate report to the corresponding authorities (National Police, Public Prosecutor’s Office, and DEMUNA).
  • User Responsibility: By formalizing the contract for our services, the traveler agrees to comply with this Code of Conduct, rejecting any illegal practice that violates the integrity of a minor.

2. Internal Management Protocol and Reporting Channels

The multidisciplinary team at ANDINA TRAVEL has the necessary preparation to mitigate risks and manage incidents related to the protection of minors.

  • Specialized Training: Our staff participates in continuous training programs regarding Law No. 29938 and internal protocols for detecting CSEC cases, ensuring preventive operations.
  • Reporting Procedure: Any detected irregularity must be communicated under strict confidentiality to the person in charge of the ANDINA TRAVEL Code of Conduct, who will initiate relevant legal actions without compromising the victim’s safety.
  • Emergency Resources: We provide our clients and staff with official reporting channels in Peru, such as the Ministry of Women’s Line 1818, which is permanently operational.

3. Regulations for the Travel of Minors

For services involving the participation of minors, ANDINA TRAVEL requires compliance with document verification protocols aligned with Peruvian immigration and notarial regulations.

  • Mandatory Documentation: In cases where the minor travels under the guardianship of only one parent or a third party, it is essential to present the duly authorized Notarial Travel Permit, in addition to a valid ID.
  • Supervision and Custody: The responsibility for the guardianship and safety of the minor rests exclusively with the father, mother, or legal guardian. ANDINA TRAVEL provides only the logistical operation of the tourism service.
  • Interaction Restrictions: Our staff is strictly prohibited from any personal contact with minors outside of scheduled operational activities and without the explicit consent of the legal guardians.

4. Hiring Guidelines and Corporate Communication

ANDINA TRAVEL extends the mandatory nature of this Code to its supply chain and brand communications.

  • Supplier Auditing: We require our business partners (hotels, transportation, restaurants) to formally adhere to the Code of Conduct and validate their own child protection protocols.
  • Visual Ethics: We prohibit the use or dissemination of audiovisual material of minors without express notarial authorization. Likewise, we guarantee that images used in our promotions maintain the utmost respect for the dignity and safety of children and adolescents.
