Terms and Conditions
This document establishes the Terms and Conditions (T&C) governing the contractual relationship between the client (traveler) and ANDINA TRAVEL, a tour operator registered and headquartered in Cusco, Peru. Our goal is to ensure maximum legal and operational transparency in the provision of services, including adventure treks and cultural tours, under strict compliance with the Peruvian legal framework: the General Tourism Law and current regulations from MINCETUR and the Regional Government of Cusco. These T&C define the rights, obligations, and responsibilities of both parties to ensure a high-quality and safe experience nationwide.
Service Commitment and Responsibility
ANDINA TRAVEL acts as a specialized intermediary between the client and end-service providers (ground transportation, air travel, hotels, etc.). Our primary responsibility lies in the planning, management, and execution of vacation packages, with a critical focus on safety during hikes to Machu Picchu and adventure routes. We commit to providing truthful and timely information. Any deficiency directly attributable to the company’s negligence will result in corrective measures according to current Peruvian legislation.
Booking, Payment, and Confirmation Process
The booking process is formalized upon the client’s request and requires a non-refundable deposit to guarantee the availability of spaces, entrance tickets (Machu Picchu, Inca Trail), and accommodations.
- Booking Confirmation: Upon receiving the deposit, ANDINA TRAVEL will issue a payment receipt and formal confirmation of the detailed itinerary.
- Final Payment: The balance must be settled by the established deadline, usually 30 days before the trip starts, except for special conditions regarding the Classic Inca Trail.
- Payment Default: Failure to pay the balance within the specified timeframe will be processed as a cancellation by the client, and corresponding penalties will apply.
- Personal Data: It is the client’s responsibility to provide accurate information (name, passport, nationality) matching their official travel documents.
Cancellation and Modification Policy
Given the nature of tourism services in Cusco (non-refundable trains and archeological site access), the following conditions apply:
Cancellation by the Client:
- 60 days or more before start: Full loss of the initial deposit.
- 30 to 59 days before start: Penalty of 50% of the total program cost.
- Less than 30 days before start: 100% penalty, with no right to a refund.
Modifications: All requests for changes to the itinerary or dates are subject to provider availability and involve additional administrative fees, plus the cost of newly issued tickets.
Cancellation by ANDINA TRAVEL: In the event of cancellation due to causes other than force majeure, an alternative program of equivalent value or a full refund of the amounts paid will be offered.
Liability, Force Majeure, and Safety
- Force Majeure: ANDINA TRAVEL is exempt from liability for delays or changes resulting from natural phenomena, strikes, social unrest, or government mandates. In these cases, we will act as facilitators, but any additional costs will be assumed by the client.
- Health and Safety: The client guarantees they are in optimal physical condition for high-altitude activities (above 9,800 feet). It is mandatory to have travel insurance with medical and evacuation coverage. The company reserves the right to exclude participants whose health status compromises their own integrity or that of the group.
- Documentation: Travelers must carry their original passport or valid ID. We are not responsible for denied access due to expired or insufficient documentation.
